Welcome to Qura. These Terms of Service govern your use of our electronic voting platform and services. Please read these terms carefully before using our platform.

1. Acceptance of Terms

By accessing or using Qura's electronic voting platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use our Services.

2. Description of Services

Qura provides an electronic voting system leveraging blockchain technology for organizations to conduct secure, transparent, and efficient electoral processes. Our Services include but are not limited to:

  • Election setup and configuration
  • Voter registration and verification
  • Secure ballot casting and tabulation
  • Real-time results tracking and reporting
  • Administrative tools and analytics

3. User Registration and Accounts

To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access to or use of your account.

4. Eligibility and User Conduct

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet all eligibility requirements.

When using our Services, you agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Services for any fraudulent or illegal purpose
  • Attempt to interfere with or compromise the system integrity or security
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in any activity that could disable, overburden, or impair the Services

Compliance with Kenyan Law

Qura operates in compliance with all applicable Kenyan laws and regulations, including:

  • Data Protection Act, 2019
  • Computer Misuse and Cybercrimes Act, 2018
  • Information and Communications Act
  • Elections Act (where applicable to private voting systems)

Users must also comply with these laws when using our Services.

5. Intellectual Property Rights

The Qura platform, including all content, features, and functionality, is owned by MicroHub and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services solely for their intended purposes and in accordance with these Terms.

6. Fees and Payment

Fees for our Services are described on our pricing page. All fees are quoted in Kenyan Shillings (KES) unless otherwise specified and are exclusive of applicable taxes.

Payment must be made in advance for the selected subscription period. We accept various payment methods as specified on our payment portal.

7. Privacy and Data Security

Your privacy and the security of your data are important to us. Our collection and use of personal information in connection with your access to and use of the Services is described in our Privacy Policy.

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk of processing personal data.

8. Limitation of Liability

To the maximum extent permitted by law, Qura and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

9. Indemnification

You agree to indemnify, defend, and hold harmless Qura and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.

10. Term and Termination

These Terms will remain in full force and effect while you use the Services. We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the Nairobi Centre for International Arbitration, which rules are deemed to be incorporated by reference into this clause.
